Here is a link to David Cooper's recent article, as an Excello Law consultant, for People Management about the recent employment tribunal decision in Hehir v Metroline. The background involved a "hero" bus driver being dismissed after he had recovered a passenger's stolen necklace from a thief, and then beat the thief unconscious when he returned to the scene of the crime.
"Unfair dismissal claims following termination for alleged gross misconduct are never easy to navigate, but they become even more uncomfortable for all involved when the sacked employee appears to be acting in what they feel is good faith. One such claim arrived in the Watford employment tribunal, when a defendant bus driver with ‘good intentions’ lost his job after a confrontation with a thief.
The case has attracted widespread media controversy, with some hailing the driver as a ‘hero’. Those who have read the ensuing tabloid reports may be asking whether dismissal fell within the range of reasonable responses." More here.
